1. About these terms
These terms apply to services provided by YourAPK, a sole trader run by Andrew Taylor in the United Kingdom. By placing an order or using the services, you agree to them. Specific written quotes or order forms take precedence where they conflict with these general terms.
2. Services & quotes
I'll provide the services described in your accepted quote. Quotes are valid for [30] days and are fixed unless the scope changes, in which case I'll agree any change with you first. Timescales are estimates given in good faith.
3. Fees & payment
One-off work may require a deposit before starting, with the balance due on completion. Recurring services (hosting, care plans, domains, email) are billed monthly or annually in advance. Invoices are due within [7] days. Recurring services may be suspended if payment is significantly overdue, after reasonable notice.
4. Domains
Domain registrations are subject to the rules of the relevant registry (e.g. Nominet for .uk) and registrar. Domains are registered in your name wherever possible and remain yours. Renewals are your responsibility; I'll remind you where I can, but I'm not liable for domains that lapse.
5. Your responsibilities
You're responsible for the content you host and for holding the rights to any materials, code or apps you ask me to work with — including apps submitted for rebranding. You must keep your account credentials secure and comply with the Acceptable Use Policy below.
6. Backups & availability
I take regular backups and work hard to keep services online, but no host can guarantee 100% uptime. You should keep your own copy of important data. Scheduled maintenance will be notified in advance where practical.
7. Liability
Nothing here limits liability that cannot be limited by law. Otherwise, my total liability for any claim is limited to the fees you paid for the affected service in the previous [12] months. I'm not liable for indirect or consequential losses, including lost profits or data.
8. Cancellation
You can cancel recurring services at any time with [30] days' notice before your next renewal. I'll help you migrate away and won't hold your data hostage. Fees already paid for the current period are non-refundable unless required by law.
9. Governing law
These terms are governed by the laws of England and Wales, and disputes fall under the exclusive jurisdiction of its courts. [Adjust if you're in Scotland or Northern Ireland.]
Acceptable Use Policy
To keep services safe and reliable for everyone, you agree not to use YourAPK hosting or services to:
- Store or distribute unlawful, infringing or malicious content, including pirated software or apps.
- Rebrand, repackage or distribute Android apps you do not own or have a licence to distribute.
- Send spam or unsolicited bulk email, or engage in phishing or fraud.
- Distribute malware, or attempt to gain unauthorised access to any system or network.
- Run activity that materially harms server performance for other clients.
Serious or repeated breaches may lead to suspension or termination. Where the law requires, I'll cooperate with legitimate authorities. If you're ever unsure whether something is allowed, just ask.
